NDAs (2019)


Information regarding the number of non-disclosure agreements that have been concluded by the House of Commons with former staff members of the House of Commons since 2012 and the gross sum paid to the employee upon departure: including pay in lieu of notice, payments to reflect lost earnings or pensionable pay.



Some of the requested information is held by the House of Commons.

Records of the requested information for 2012 are no longer held by the House. These records have been deleted in line with the House's Authorised Records Disposal Practice (ARDP) which can be found on our parliamentary pages.

A record of the requested information for the period 2013-2017 was requested under a separate Freedom of Information Act 2000 (FOIA) request in 2018. We disclosed 49 such payments for that period and published our response on the parliamentary website. As the information you request is reasonably accessible to you otherwise than under the FOIA, the House is exempting the information under the exemption set out in section 21(1) and (2)(a) FOIA.  This is an absolute exemption and the public interest test does not apply.

The House holds information relating to individual leaver payments subsequent to our previous disclosure.
The gross sum of the 13 individual payments made to leavers from 1 January 2018 to 31 December 2019.
Please note that the House suspended the inclusion of non-disclosure agreements in settlement agreements in 2018. Therefore, none of the 13 payments here were paid subsequent to an NDA.
