10.05.2012Audit Commission: abolition
Eric Pickles, Communities Secretary, announced the abolition of the Audit Commission on 13 August 2010. This note discusses the current regime and the Government's proposals, under which local authorities would regain the right to choose their own auditors, and a new decentralised audit regime covering local government, police and health bodies would be established. The National Audit Office would oversee the audit of local government and health, and the Audit Commission's own audit practice would be transferred out of the public sector.
10.05.2012Local government: the standards regime in England and the abolition of Standards for England
The Coalition Government announced in their Programme for Government in May 2010 that Standards for England, and the standards regime for England, would be abolished. This was provided for by the Localism Act 2011. This regime replaces the Labour Government's ethical framework for local councillors that was introduced by the Local Government Act 2000 and amended by the Local Government and Public Involvement in Health Act 2007. This note discusses the new regime.

The Localism Act 2011 removed this duty. This note briefly describes the duty established under the 2009 Act and the reasons for its abolition. 24.04.2012Tax increment financing
Deputy Prime Minister Nick Clegg announced on 20 September 2010 that the Coalition Government would allow local authorities to use tax increment financing (TIF) in order to finance infrastructure projects. This would be implemented by the Local Government Finance Bill 2010-12, which is currently awaiting report stage in the House of Commons. TIF has been used in the United States for approximately forty years and has generally been seen as a success. It is also being developed in Scotland. This note discusses the thinking behind TIF and considers recent developments.
18.04.2012Council tax : discount on second homes and long-term empty properties
The Local Government Act 2003 changed the rules on council tax on second homes to allow English councils the discretion to reduce the discount from the previously prescribed 50% to a minimum of 10%. The Local Government Finance Bill 2010-12 would introduce new measures to give councils discretion over what discount - if any - should apply to empty properties. Ministers have also indicated during the passage of the Bill that they intend to give the same discretion in relation to the discount on second homes, although this could be done by regulations under existing legislation. This note describes these changes in more detail.

It seeks to implement Lord Young's recommendations concerning an appeal process where an event has been banned or restricted by a local authority on health and safety grounds. The Bill's name has been changed in committee to the Local Government (Review of Decisions) Bill.
16.01.2012Community budgets
The Government announced in the comprehensive spending review on 20 October 2010 that it would introduce community budgets. These would initially be set up in 16 pilot areas before being made available elsewhere in England. The introduction of community budgets will be considered further during the second part of the local government resource review. A second round of pilot schemes was announced by the Government on 2 December 2011.

The Chief Executives of Westminster City Council, the London Borough of Hammersmith and Fulham and the Royal Borough of Kensington and Chelsea have issued a consultation paper called Tri-Borough Proposals Report. The report is a response to the Government's local government finance settlement as well as to its localism and Big Society agendas, and proposes that a number of the council's services are merged or managed jointly. It also proposes that many of the staff of the authorities will be shared. The proposals are one of a number of such initiatives across local government. 03.03.2010Councillors and Council Control: 1979-2009
The following note looks at the number of councillors by party in Great Britain since 1979. In 2009 there were around 4,700 fewer councillors in Great Britain than in 1979. This is as a result of numerous changes to the structure of local authorities, particularly the introduction of unitary authorities in Wales and Scotland in 1995, when the number of councillors fell by 1,605. In 2009 the Conservatives are 5,270 councillors better off compared to 1996 when they had 4,276 councillors. Labour has less than half the number of councillors compared to 1996 (11,000). The Conservatives have also seen a gradual increase in the number of councils it controlled in England since 1998 when they had 24 compared to 209 in 2009. Labour on the other hand had seen a steady decrease since 1998 when they controlled 140 councils to the current level of 37 councils in 2009.

This Research Paper has been prepared for the second reading of the Local Government Finance Bill 2010-12. The Local Government Finance Bill has been carried over into the 2012-13 session as Bill 4 of 2012/13. The Bill had completed its Committee Stage before the end of the 2010-12 Session and will have its remaining stages on 21 May 2012. Research Paper 12/14 considers the proceedings on the Bill before it was carried over.

12.04.2011Localism Bill: Committee Stage Report
This paper covers the Commons Committee Stage of the Bill, and complements Research Papers 11/02 and 11/03, prepared for Second Reading. The Bill covers a wide range of topics in local government, planning, housing and the governance of London. It was not substantially amended in Committee, although there were some minor technical Government amendments. However, at several points, Ministers agreed to look again at certain issues and consider whether to introduce amendments at Report Stage.

Central government will provide approximately £73bn in grants to local authorities in England in 2011/12. This funding is made up of the formula grant, comprised of revenue support grant, redistributed business rate income and Home Office Police Grant where appropriate, and specific grants.

Specifically, it would prevent implementation of any of the existing proposals for single-tier local government made under the Local Government and Public Involvement in Health Act 2007. No amendments were made to the Bill in committee.

The Bill completed its passage through the House of Lords and was introduced into the House of Commons on 11 October 2010. This briefing was prepared to inform the Second Reading debate on the Bill.

This paper summarises the results of the local and mayoral elections held on 6 May 2010. Elections were held in all 32 London boroughs, 36 metropolitan boroughs, 20 unitary authorities, and 76 shire districts. Labour had a net gain of 17 councils, the Conservatives a net loss of seven and the Liberal Democrats a net loss of one. Four incumbent mayors were re-elected: in the London Boroughs of Hackney, Lewisham and Newham (all Labour), and in Watford (Liberal Democrat). The UK General Election was held on the same day.

24.02.2010Sustainable Communities Act 2007 (Amendment) Bill [Bill 21 of 2009-10]
The Bill seeks to amend the 2007 Act by setting a deadline for the Secretary of State to initiate the next round of proposals for enhancing the sustainability of local communities from local authorities under the Act. It provides for regulations to be made specifying the rules for this process. These are also to cover parish council involvement and the role of local petitioning. There is also provision for greater flexibility in decision-making on proposals.

The Bill is based on proposals in the 2009 Communities and Local Government Green Paper 'Strengthening Local Democracy'. The Bill strengthens local government overview and scrutiny committee powers in relation to partner organisations, so that they could potentially cover a greater range of external authorities. The activities which would be subject to such scrutiny are defined as matters of local concern in the area. The Bill provides for executive members to sit on committees involved in scrutiny of external bodies. It also makes provision for the resourcing of overview and scrutiny.

15.06.2009Local elections 2009
This paper summarises the results of the local and mayoral elections held on 4 June 2009. Elections were held in all 27 shire counties in England (all seats) and seven English unitary authorities (Bedford, Bristol (one-third of seats), Central Bedfordshire, Cornwall, Isle of Wight, Shropshire and Wiltshire). The Conservatives made a net gain of seven councils and 244 seats. Labour made a net loss of four councils and 291 seats. The Liberal Democrats made a net loss of one council and two seats. The Greens gained eight seats in net terms while the UK Independence Party made a net gain of seven seats, and the British National Party made a net gain of three seats Estimates suggest that the Conservatives won 35% of the national equivalent share of the vote, Liberal Democrats 25% and Labour 22%. Turnout was estimated to be 35%. There were mayoral elections in three areas and UK-wide elections for the European Parliament on the same day

This paper covers parts 4 to 8 of the Local Democracy, Economic Development and Construction Bill [HL]. The Bill implements a number of changes in relation to regional and sub-regional economic development and planning, including: an economic assessment duty for local authorities; a new regional strategy process for English regions outside London; new Local Authority Leaders' Boards to agree the strategy with Regional Development Agencies; provisions for further sub-regional partnerships through Economic Prosperity Boards and Multi-Area Agreements. The Bill also amends the Housing Grants, Construction and Regeneration Act 1996 in relation to construction contracts with the aim of improving cashflow and the adjudication process in the industry. The Bill gives legislative effect to the scheme outlined in Business rate supplements: a white paper (Cm 7230). This allows upper-tier local authorities, and the Greater London Authority, to levy a supplement on the business rate in order to fund local economic development projects. Businesses must be consulted and, in certain circumstances, balloted before a rate supplement can be introduced.
