Instrument of Delegation

Instrument of Delegation, as amended by the House of Commons Commission in April 2016. 

Introduction

In pursuance of paragraph 5 of Schedule 1 of the House of Commons (Administration) Act 1978, the House of Commons Commission hereby amends the Instrument of Delegation made by the Commission on 13 July 2015.

Clerk of the House

In pursuance of paragraph 5(2) of Schedule 1 of the House of Commons (Administration) Act 1978, and subject to the proviso in Section 2(4) of the said Act, the House of Commons Commission hereby delegates, with effect from 15 June 2015,  to the Clerk of the House of Commons responsibility for the appointment of staff under Section 2(1) of the of the House of Commons (Administration) Act 1978, except for appointments delegated to Mr Speaker and the following positions, which will remain matters for the Commission:

  • The Director General of the House Commons
  • The Director of Finance
  • The Parliamentary Security Director
  • Any other position that is the head of a House Department or a member of the Executive Committee.

In the absence of a Clerk of the House, these functions shall be exercised by whoever has been appointed by the Commission as Accounting Officer.

Mr Speaker

In pursuance of paragraph 5(1) of Schedule 1 of the House of Commons (Administration) Act 1978, the House of Commons Commission hereby delegates to Mr Speaker, with effect from 15 June 2015, its functions under section 2(1) of the said Act of appointing the:

  • Speaker’s Secretary
  • Speaker’s Counsel

Executive Committee

In pursuance of paragraph 5(2) of Schedule 1 of the House of Commons (Administration) Act 1978, the House of Commons Commission hereby establishes the Executive Committee.

The membership of the Executive Committee shall be the Director General of the House of Commons, and the Director of Finance. The Director General of the House of Commons shall be chair of the Executive Committee, or, in his/her absence, the Clerk of the House.

The Executive Committee shall: 
  1. be responsible for ensuring that the conditions of the service of staff in the House of Commons Service conform to the provisions of sections 2(2) and 2(3) of the House of Commons (Administration) Act 1978;
  2. exercise on behalf of the Commission its other functions concerning staff in the House Service (except those relating to the appointment of staff under section 2(1) of the House of Commons (Administration) Act 1978 and those relating to House Departments under section 4 of the Act);
  3. exercise on behalf of the Commission the responsibilities referred to in paragraph 5(5) of Schedule 1 of the House of Commons (Administration) Act 1978 for considering representations made in relation to matters affecting the interests, in connection with their employment, of staff in the House Service by trade unions who are recognised by the Commission in respect of such staff, and for the conduct of consultations and negotiations about such matters with those trade unions, subject always to the ultimate right of those trade unions to make representations to the Commission in cases where the procedures established under the authority of the Commission and agreed by both sides of the House of Commons Whitley Committee, have been exhausted.

Subject to the above, the Executive Committee shall also:

  1. support and advise the official members of the House of Commons Commission in the performance of their functions, in particular the delivery of the strategy for services set by the House of Commons Commission;
  2. advise the Corporate Officer of the House of Commons on the nature and level of services that should be provided by joint departments of the two Houses;
  3. assist the Finance Committee in the preparation of the Administration Estimate and of other papers relating to that Vote, before their submission to the House of Commons Commission; and
  4. carry out such other functions relating to the expenditure on the administration of House of Commons services as may from time to time be allocated to it by the Commission.

The Executive Committee shall exercise its powers subject to the control of the Accounting Officer in relation to expenditure.
