Regulatory Reform Committee

Session 2002-03        18 March 2003

Draft Regulatory Reform (Schemes under Section 129 of the Housing Act 1988) (England) Order 2003

On 11 March 2003 the Government laid before Parliament the draft Regulatory Reform (Schemes under Section 129 of the Housing Act 1988) (England) Order 2003 under the procedure laid down by the Regulatory Reform Act 2001.  The draft order would amend section 129 of the Housing Act 1988 by removing the requirement for local housing authorities in England to obtain approval from the Secretary of State where they wish to operate a cash incentive scheme.  A cash incentive scheme provides for payments to assist tenants in obtaining other accommodation.

In accordance with our Standing Order, we have considered this draft order and have recommended unanimously to the House that it be approved.  The draft order has been revised in accordance with our comments about the proposal for the draft order, published on 12 February 2003.  As a consequence of the revision, the draft order would no longer re-enact a provision having the effect of imposing a burden on local housing authorities in Wales.

The Committee's full report will be published as its Tenth Report of the current Session, HC 549, at 2.00 pm on Wednesday 19 March. The report will be available from all Stationery Office outlets. It will also be available on the Committee's website from 3.30pm on the day of publication.
