PUBLICATION OF REPORT

THE SUB JUDICE RULE OF THE HOUSE OF COMMONS

The Sub judice rule of the House of Commons will be published as the First Report of Session 2004-05, HC 125, at 11.00 a.m. on Monday 4 April 2005.

The Report examines the operation of the rule, which is currently embodied in a Resolution of the House of 15 November 2001 and prevents reference being made in proceedings in the Chamber or in committees to cases which are active in the courts. The rule does not apply when the House is considering primary or secondary legislation, and the Chair has discretion to disapply it on other occasions.

The Committee has taken evidence from the Clerk of the House, the Principal Clerk of the Table Office, the Attorney General, Lord Nicholls of Birkenhead (who chaired the Joint Committee which drafted the current rule) and Ms Sally Keeble MP. This oral evidence is already published on the website and will be included with the Report, together with some written evidence.

There will be no advance copies and no press conference.
